Partition rights are governed by the National Civil Code. The applicable shares depend on the family relationship, the nature of the property, whether partition has already occurred and other facts relevant under the Code.
A partition analysis should first distinguish:
- common/partitionable family property;
- separately owned property;
- property acquired after separation;
- inherited property;
- property subject to a will or transfer.
