Can someone sell land through a power of attorney?

Property & Land Law

A person can act through legally valid authority where law permits, but the scope, authenticity and continuing validity of the power of attorney should be checked carefully before any land transfer.

Verify

  • identity of principal and attorney;
  • power to sell the particular property;
  • formal validity;
  • expiry or revocation;
  • whether the principal is alive and legally capable where relevant;
  • compliance with land-office requirements.
