Can someone be legally treated as an employee without a written contract?

Labour & Employment Law

Yes, in some circumstances. Section 12 recognizes that an employment relationship can arise through an employment agreement, oral employment, or commencement of work/service in casual employment.

An employer's failure to provide the required written document does not necessarily erase the employment relationship.
