Can an employer punish an employee for making a lawful labour complaint?

An employer should not treat the lawful exercise of labour rights as misconduct merely because the worker raised a lawful grievance, complaint or participated in lawful labour activity.

Section 126 specifically provides that lawful complaint and specified lawful collective activity do not by themselves constitute breach of the employment agreement.
