Can police arrest a person without a warrant in Nepal?

Yes, but not in every situation. Section 9 of the Criminal Procedure Code permits arrest in specified circumstances, including when a person connected to an offence is found or is caught committing it. The Code also provides an urgent-arrest procedure where delay creates a reasonable risk of escape or destruction of evidence.

Outside such situations, the Code provides for judicial authorization of an arrest warrant during investigation.
