Can an accused appeal without remaining in prison?

Criminal Law

It depends on the sentence and statutory conditions. The Criminal Procedure Code contains rules governing when a convicted person must remain in custody, provide security or obtain permission to pursue an appeal outside custody.

This issue should be reviewed from the exact sentence and section 137 rather than assuming that filing an appeal automatically suspends imprisonment.
